IT IS KNOWN THAT EVERY BOAT OR YACHT THAT HAS AN
INSURANCE POLICY HAS CLAUSES THAT SHOULD BE TAKEN
INTO CONSIDERATION WHEN IN A SITUATION IN WHICH THE
USE OF THIS POLICY IS CONTEMPLATED. THEY SET OUT
PROTOCOLS AND ORDERS OF ACTIONS THAT SHOULD BE TAKEN
INTO CONSIDERATION IN ORDER TO MAINTAIN GOOD COURSE
AND SUPPORT FOR A POSSIBLE POLICY CLAIM.
For this the following must be taken into
account:
STEP 1. AT THE TIME OF THE ACCIDENT

Check that there are no injuries and assist
each person possibly affected

Take video and photo records for evidence of
the accident, its scope, location and
conditions. This will help to understand the
case at its origin and the actions that
follow it.

To the extent possible, protect the
integrity of people and the ship to avoid
the chain of events, the propagation of
risks and damages.
- Inform the authorities (if applicable)

Inform MWS INT S.A., the Broker, the
insurance company (if applicable), about the
occurrence of the incident, without
providing further details due to the
possible lack of knowledge of the cause and
consequences that may arise immediately and
which must be subject to further
investigation.
STEP 2. SCOPE VERIFICATION
CHECK WHETHER OR NOT THE CLAIM WILL BE FILED
ACCORDING TO THE COST AND TYPE OF SCOPE OF THE
DAMAGE. It is not always appropriate to file a
claim with the insurance company after damage,
as its scope is often unknown in the event of a
simple or minor damage, that is, one that does
not immediately imply a major risk and its
repair can be absorbed by the client. However,
it may happen that after a while, this initial
damage continues to expand its effects to other
damages and costs resulting from it. Therefore,
it is best to seek advice from professionals
(Maritime Works Int. S.A. - Yacht Surveyors) who
can advise and determine the degree of scope for
its proper notification to the insurance company
and the broker.
STEP 3. ASSIGNMENT OF ACTORS
HIRING ADVISORS AND ASSIGNMENT OF PARTICIPANTS
The Client: It is the right of the insured
client to hire (Maritime Works Int. S.A. - Yacht
Surveyors) so that in compliance with the
policy, they can carry out the technical studies
and investigation of the scope, determine the
cause of the accident and make estimates of the
costs of repair or replacement of the damages in
advice and representation of the client. The
Insurance: Assigns an adjustment company who
classifies an expert who will make the request
of items to be presented and will make the
relevant reviews and verifications as applicable
to the scope of the policy, technical expertise
and local laws.
STEP 4. CLAIM COURSE
FIELD WORK Phase in which (Maritime Works Int.
S.A. - Yacht Surveyors) must carry out technical
inspections by area and equipment for the
identification and estimation of scope. The
expenses arising from these inspections must be
borne by the affected client. It is possible for
the expert adjuster assigned by the insurance
company to visit the ship on several occasions.
STEP 5. PRESENTATION OF THE COMPENDIUM OF CLAIMS
EDITING AND DELIVERY OF THE CLAIM DOCUMENT Once
the items requested by the adjuster have been
grouped, the estimates, documents, supports and
evidence of the scope and determination of the
claim request are presented for review by the
adjustment company assigned by the insurance
company. In this phase, visits to the ship and
verification of the condition of the parts in
the claim may apply. The document is delivered
to the client who determines the order of
delivery and/or delivery channel to the
insurance company. (Applicable via broker).
STEP 6. ADJUSTMENT
REVIEW OF THE CLAIM DOCUMENT AND ADJUSTMENT The
expert appointed by the adjustment company
performs the verifications and/or adjustments of
values based on the reviews and supports
provided by (Maritime Works Int. S.A. - Yacht
Surveyors).
STEP 7. REVIEW OF THE ADJUSTMENT
ACCEPTANCE / NON-ACCEPTANCE OF ADJUSTMENT The
client has the right to demand support for the
determinations and grounds for non-acceptances
of the adjuster in the event of any disagreement
in these. (Maritime Works Int. S.A. - Yacht
Surveyors) may make the pertinent revisions for
interaction with the adjuster.
STEP 8. AGREEMENT OF PARTIES
ACCEPTANCE OF FINAL ADJUSTMENTS Once the reviews
have been completed and adjustments made, the
figure and conditions for resolving the case
must be specified based on the scope and support
presented and supported.
STEP 9. FINAL PAYMENT
PAYMENT OF CLAIM The insurance company must make
the payment according to the conditions of the
contract, for which they apply discounts for
deductibles according to areas and scope of the
condition.
